1. Agreement to Terms

By accessing or using GlitchLabs' services, you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use our services.

2. Services Offered

GlitchLabs provides website design and development services, including:

  • Custom website design and development
  • Website hosting and domain setup assistance
  • Content management system integration
  • Website maintenance and support
  • SEO optimization services

3. Project Process

3.1 Consultation

Projects begin with a free consultation to understand your requirements. After consultation, we provide a detailed quote outlining scope, timeline, and pricing.

3.2 Timeline

Standard project timeline is 2-3 weeks from project start to launch. Delays caused by client feedback or content provision may extend this timeline.

3.3 Revisions

All packages include unlimited revisions during the design phase. Once the design is approved and development begins, major changes may incur additional fees.

4. Payment Terms

4.1 Payment Structure

Standard payment terms:

  • 50% deposit required to begin work
  • 50% final payment due before website launch
  • Alternative payment plans available for Premium package (contact us)

4.2 Pricing

All prices are in South African Rand (ZAR) and exclude VAT unless otherwise stated. Prices are valid for 30 days from quote date.

4.3 Refunds

Deposits are non-refundable once work has commenced. If you are unsatisfied with the final product, we will work with you to resolve issues before requesting final payment.

5. Client Responsibilities

Clients are responsible for:

  • Providing content (text, images, logos) in a timely manner
  • Providing timely feedback during design and development phases
  • Ensuring all content provided is legally owned or licensed
  • Maintaining website hosting and domain registration (if not managed by us)
  • Making payments according to agreed terms

6. Intellectual Property

6.1 Client Ownership

Upon full payment, clients own all custom design work, content, and materials created specifically for their project.

6.2 Third-Party Assets

Stock images, fonts, and third-party plugins remain the property of their respective owners. Appropriate licenses are obtained for all commercial use.

6.3 Portfolio Rights

GlitchLabs retains the right to display completed work in our portfolio and marketing materials unless otherwise agreed in writing.

7. Support and Maintenance

7.1 Free Support Period

All projects include 30 days of free support post-launch. This covers:

  • Bug fixes and technical issues
  • Training on website management
  • Minor content updates

7.2 Ongoing Support

Optional ongoing support available at R800/month after the free period. This includes regular updates, monitoring, and priority support.

8. Warranties and Disclaimers

8.1 Service Warranty

We warrant that all work will be performed in a professional and workmanlike manner. We guarantee that websites will function as specified at the time of launch.

8.2 No Guarantee of Results

While we design websites to be effective, we make no guarantees regarding search engine rankings, traffic levels, or business results. SEO and marketing success depend on many factors beyond website design.

8.3 Third-Party Services

We are not responsible for the performance, availability, or policies of third-party services (hosting providers, domain registrars, etc.).

9. Limitation of Liability

To the fullest extent permitted by law, GlitchLabs shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly.

Our total liability shall not exceed the amount paid by the client for the specific services in question.

10. Project Cancellation

10.1 Client Cancellation

Clients may cancel projects at any time. Deposits are non-refundable, and clients will be billed for work completed to date at standard hourly rates.

10.2 GlitchLabs Cancellation

We reserve the right to cancel projects if:

  • Payment terms are not met
  • Client fails to provide necessary materials after reasonable requests
  • Client engages in abusive or unprofessional behavior

In such cases, completed work will be provided, and a prorated refund may be issued at our discretion.

11. Confidentiality

We agree to keep all client information confidential and will not disclose it to third parties except as necessary to complete the project or as required by law.

12. Governing Law

These Terms of Service shall be governed by and construed in accordance with the laws of South Africa. Any disputes shall be subject to the exclusive jurisdiction of the courts of South Africa.

13. Changes to Terms

We reserve the right to modify these Terms of Service at any time. Changes will be posted on this page with an updated "Last updated" date. Continued use of our services after changes constitutes acceptance of the modified terms.
